The 2026 Legislative Session continues to move quickly, and Black Hills & Badlands Tourism Association (BH&B) and the Tourism Coalition of South Dakota (TCSD) are actively monitoring bills that may impact the visitor industry. 

Several of the bills we were tracking earlier in session have now been withdrawn or deferred to the 41st day. While BH&B and TCSD continue to monitor a wide range of legislation, the measures listed below are those we believe may be of particular interest to our BH&B members and the visitor industry. 

 

Senate Bill 36


An Act to authorize utilities to establish wildfire mitigation plans and associated liability limitations for wildfire damages. 
SB 36 has passed the Senate and was read in the House, where it has been referred to the House Commerce and Energy Committee. A hearing date has not yet been scheduled. 

 

Senate Bill 76


An Act to transfer moneys from the housing infrastructure fund to the revolving economic development and initiative fund, and to authorize loans from the revolving economic development and initiative fund for airport infrastructure. 
SB 76 was scheduled for hearing in the Senate Commerce and Energy Committee this morning. The Committee unanimously voted in favor. The bill will now advance.  

 

Senate Bill 102


An Act to modify the distribution of gaming revenues. 
SB 102 is scheduled for hearing in the Senate Committee on Appropriations on February 23. As gaming revenues play a role in community and tourism-related funding, this bill remains one we are following closely. 

 

Senate Joint Resolution 504


A Joint Resolution proposing and submitting to the voters at the next general election an amendment to the Constitution of the State of South Dakota, providing for wagering on sporting events via mobile or electronic platform. 
SJR 504 has passed the Senate and has been referred to the House State Affairs Committee. 

 

 

BH&B and TCSD will continue to monitor legislation that may impact tourism, economic development, visitor access, and community vitality across our region.
